1. Acceptance of Terms
By accessing and using Kizana (hereinafter referred to as "the App"), you agree to comply with and be bound by these Terms and Conditions. These Terms and Conditions govern your use of the App.
2. Application Overview
At Kizana, we aim to transform your daily fashion experience. Our digital mobile wardrobe application provides tailored outfit recommendations and aids in organizing your wardrobe digitally. We are dedicated to promoting not just personal style but also sustainable fashion choices. With Kizana, you have the unique opportunity to “Wear your story”.
3. Membership
a. **Kizana Membership Continuation:** Your Kizana membership will continue until terminated. To utilize the Kizana service, you must have Internet access, a compatible mobile device, and provide us with one or more Payment Methods. “Payment Method” means a current, valid, accepted method of payment, which may be updated occasionally and might include payment through your account with a third-party provider.
b. **Membership Plans:** We may offer a range of membership plans, including those provided by third parties in conjunction with their products and services. Kizana is not accountable for the products and services provided by such third parties. Different membership plans may have distinct conditions and limitations, disclosed during your sign-up or through subsequent communications. Specific details about your Kizana membership can be found within the App under the “Manage Kizana Packages” section.
4. Billing and Cancellation
a. **Billing Cycle:** The membership fee for the Kizana service and any additional charges (e.g., taxes, transaction fees) will be billed to your Payment Method on the specified payment date indicated within the “Manage Kizana Packages” section of the App. The duration of your billing cycle is determined by your chosen subscription type during sign-up. Payment dates might change under circumstances like unsuccessful Payment Method settlements, subscription plan changes, or unique calendar month considerations.
b. **Payment Methods:** A Kizana subscription requires one or more Payment Methods. If your primary Payment Method is declined or unavailable, you grant us permission to charge any secondary Payment Methods. You are accountable for any outstanding amounts. If payments aren't successfully settled due to reasons like expiration or insufficient funds, and you don't terminate your account, we may suspend your access until successful payment is made.
c. **Updating Payment Methods:** Users can update Payment Methods by accessing “Manage Kizana Packages” section of the App. Kizana may occasionally update your Payment Methods with details provided by payment service providers. Post any update, you grant us permission to continue charging the applicable Payment Method(s).
d. **Cancellation:** Kizana memberships can be terminated at any time. After cancellation, you will retain access to the Kizana service until the conclusion of your current billing period. Payments are non-refundable, without credits for partial membership durations or unutilized Kizana content. Cancellation instructions are within the “Manage Kizana Packages” section. For memberships via third-party Payment Methods, cancellation might require processes on those platforms.
e. **Changes to Subscription and Price:** Kizana may occasionally adjust subscription plans or service pricing. These changes will be effective no sooner than 30 days after you are notified. If you reject any change, you have the option to cancel your subscription before the updated terms are applied.
6. Usage Restrictions
a. **Prohibited Uses:** Users are expected to refrain from using the App for illicit or unauthorized purposes and must not undermine the security or disrupt the seamless functioning of the App. Additionally, users can’t attempt to create accounts or access or collect information in an unauthorized way; this includes creating accounts or collecting information in an automated way without our express permission.
b. **Chatbot and Image Segmentation:** The Chatbot and Image Segmentation features within the App are provided for the sole purpose of enhancing the user's fashion experience. Users should not misuse or exploit these features for any purposes other than those related to fashion and their intended use in the App. Improper use or attempts to repurpose these tools for unrelated tasks may result in termination of user access to the App.
7. Intellectual Property
Except for user-generated content, all rights concerning the App and its content are reserved by Kizana. Unauthorized use may be treated as a violation of copyright, trademark, and other relevant UAE laws.
8. Limitation of Liability
Kizana, its developers, or affiliates will not bear responsibility for any indirect, incidental, special, consequential, or exemplary damages resulting from your use or inability to use the App.
9. Modifications
Kizana retains the right to modify or revise these Terms and Conditions. Users are encouraged to periodically review the Terms and Conditions for any updates as we may change our services and policies and need to make changes to these Terms and Conditions so that they accurately reflect our services and policies. Unless otherwise required by law, we will notify you before making changes to these Terms and Conditions and give you an opportunity to review them before they go into effect. In case you do not agree to these updated Terms and Conditions, you can delete your account.
10. Termination
Kizana reserves the authority to terminate or suspend your access to the App for any reason, without prior notice or liability.
11. Governing Law
These Terms and Conditions are governed and interpreted in accordance with the laws of the United Arab Emirates.
